DISTANCE SALES CONTRACT


ARTICLE 1 - PARTIES

This Distance Sales Agreement (“Agreement”);

between the parties under the following terms and conditions.



ARTICLE 2 - SUBJECT

This Agreement regulates the provisions regarding the sale, delivery and the rights and obligations of the parties regarding the sale and delivery of the products / services whose qualifications and sales price are specified below, which the Buyer ordered through the ergomekan.com website (“Site”) belonging to the Seller.



ARTICLE 3 - PRODUCT AND SERVICE INFORMATION

The main features, sales price, payment method and delivery information of the product/service purchased by the buyer are as follows:

By accepting this Agreement, the Buyer accepts and declares that he/she has been fully and accurately informed about the basic characteristics of the product/service ordered, the total sales price and the payment obligation.



ARTICLE 4 - DELIVERY AND PERFORMANCE

  • The product is sent to the delivery address specified by the Buyer via HepsiJet CARGO or other CARGO determined by the seller within 1-3 business days after the order is confirmed.
  • Delays in orders to be delivered by the cargo company are not the responsibility of the Seller.
  • The Buyer is obliged to ensure the accuracy of the address specified during the order.
  • If the Buyer is not present at the address at the time of delivery, the delivery rules determined by the cargo company shall apply.


ARTICLE 5 - RIGHT OF WITHDRAWAL

  • The buyer has the right of withdrawal within 14 days from the date of receipt of the product without any justification and without penalty.
  • The products to be returned within the scope of the right of withdrawal must be in their original packaging, complete and unused.
  • If the right of withdrawal is exercised, the return shipping fee is covered by ANKA GLOBAL MİMARLIK SANAYİ VE TİCARET LİMİTED ŞİRKETİ.
  • The right of withdrawal is not valid in the following cases:
    • Products produced in accordance with the special requests of the Buyer.
    • Products that have been used, assembled or not for resale.
    • Products that may deteriorate quickly or whose expiration date is approaching.

The Buyer who wishes to exercise the right of withdrawal must notify the Seller by sending an e-mail to info@ergomekan.com or by telephone.



ARTICLE 6 - CANCELLATION AND RETURN CONDITIONS

  • The order can be canceled before shipping.
  • The return period is 14 days after receipt of the product.
  • The product must be complete, unused and in resalable condition.
  • Cargo damaged products should not be received and a report should be made to the cargo officer.
  • It is the Buyer's responsibility to ship the product and notify the Seller of the tracking number during the return process.


ARTICLE 7 - PAYMENT AND SECURITY

  • The buyer can pay by credit card, bank transfer or EFT during the purchase process.
  • Payments are processed with secure payment infrastructure and 3D Secure security system is applied.
  • The storage of the Buyer's credit card information is not done by the Seller.
  • The Seller is not responsible for any errors or security breaches that may occur during payment.


ARTICLE 8 - AUTHORIZED COURT AND DISPUTE RESOLUTION

  • Consumer Arbitration Committees and Consumer Courts are authorized in the implementation of this Agreement.
  • The parties agree to resolve potential disputes primarily through negotiation.
  • The Buyer may send its complaints and requests to the e-mail address info@ergomekan.com or 0850 000 00 00 00 number.


ARTICLE 9 - EFFECTIVE

This Agreement shall be deemed to have entered into force between the parties as of the moment the Buyer places an order on ergomekan.com.
